This Privacy Policy explains how Formwerk collects, uses, stores and discloses personal information when you visit formwerk.io, create an account, use the Formwerk service or contact us.
In this policy, Formwerk, we, us and our mean Formwork Studios. The Service means the Formwerk website, application and related services.
Formwerk is business development management software for architecture practices. It allows users to manage information relating to submissions, projects, organisations, contacts, events, marketing initiatives, responsibilities, deadlines, workloads and related reporting.
1. Information we collect
Account and subscription information
When you create or administer an account, we may collect information such as your name, work email address, organisation, account role, authentication information, subscription details and billing contact information.
If you purchase a paid subscription, payment information may be collected and processed by a third-party payment provider. Formwerk does not intentionally store complete payment card numbers.
Customer Data
You and other users may add information to the Service, including:
- project and submission information;
- organisation and contact details;
- event and marketing information;
- tasks, responsibilities, notes and deadlines;
- workload, activity and reporting information; and
- files, comments or other material entered into the Service.
Some Customer Data may contain personal information about employees, clients, consultants or other business contacts. The customer that controls the account is responsible for ensuring it has the authority to collect and enter that information into Formwerk, and for providing any notices or obtaining any consents required by law.
Usage and technical information
When you use the website or Service, we and our service providers may collect technical information such as your IP address, browser and device type, approximate location, pages viewed, features used, dates and times of access, referring pages, error information and other diagnostic data.
Communications
We collect information you provide when you contact us, request support, respond to a survey or send feedback.
2. How we use information
We use personal information and Customer Data to:
- provide, operate and maintain the Service;
- create and secure accounts and authenticate users;
- display, organise and report on information entered by users;
- administer free and paid subscriptions;
- respond to enquiries, provide support and communicate service information;
- diagnose faults, monitor performance and improve the Service;
- protect the security and integrity of the Service and prevent misuse;
- comply with legal obligations and respond to lawful requests; and
- send product news or marketing communications where permitted by law. You can opt out of marketing emails at any time.
We do not sell, rent or trade personal information or Customer Data. We do not give it to third parties for their own advertising or marketing purposes.
3. When we disclose information
We disclose information only where reasonably necessary for the purposes described in this policy, including to:
- hosting, infrastructure and database providers;
- authentication, email, customer support and payment providers used to operate the Service;
- analytics providers, including Google Analytics on the Formwerk website;
- professional advisers where reasonably necessary;
- regulators, courts, law enforcement agencies or other parties where required or authorised by law;
- a purchaser or successor in connection with a proposed or completed sale, merger, restructure or transfer of the Formwerk business, subject to appropriate confidentiality and privacy protections; or
- another party where you have directed or authorised us to do so.
Service providers may only use the information made available to them for the services they provide to us, subject to their contractual terms and applicable law.
4. Hosting and overseas processing
Formwerk uses third-party cloud hosting and infrastructure providers to operate the Service. Customer Data is hosted in North America, including the United States. These providers may process Customer Data only as necessary to provide infrastructure, security, backup and support services.
Other service providers used by Formwerk, including Google, may also process information in the United States or other countries in which they operate. Privacy protections in those countries may differ from those in Australia.
By using the Service and providing information to Formwerk, you acknowledge that information may be stored and processed outside Australia as described in this policy.
5. Cookies and analytics
The Formwerk website uses cookies and similar technologies required for website functionality and to understand how the website is used.
We use Google Analytics to collect aggregated information about website visits and interactions. Google may collect information such as your IP address, browser type, device information and pages visited. The website also uses Google Fonts. Google's handling of information is described in the Google Privacy Policy.
You can restrict or block cookies through your browser settings. Doing so may affect some website or Service functionality.
6. Data security
We take reasonable administrative and technical steps to protect personal information and Customer Data from misuse, interference, loss and unauthorised access, modification or disclosure. These steps include account authentication, access controls and the infrastructure, backup and recovery measures provided by our hosting providers.
No internet service or electronic storage system is completely secure. We cannot guarantee that information will never be accessed, disclosed, altered or lost as a result of circumstances beyond our reasonable control.
If we become aware of a data breach, we will investigate and respond in accordance with applicable law, including notifying affected individuals and regulators where required.
7. Data retention and deletion
We retain account information and Customer Data while an account is active and for as long as reasonably necessary to provide the Service, meet legal and accounting obligations, resolve disputes and protect our legitimate interests.
When an account is closed or deletion is requested, we will delete or de-identify information that we no longer need, subject to legal obligations and reasonable technical limitations. Residual copies may remain in backups for a limited period until they are overwritten through ordinary backup cycles.
To request closure of an account or deletion of personal information, contact us at studio@formwerk.io. Before requesting deletion, customers should retain any copies of Customer Data they need. Deletion may be irreversible.
8. Access and correction
You may ask us to provide access to personal information we hold about you or to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading.
To make a request, email studio@formwerk.io. We may need to verify your identity before completing the request. In some circumstances, applicable law may permit or require us to refuse access. If that occurs, we will explain the reason where we are legally able to do so.
9. Your responsibilities when entering personal information
If you enter personal information about another person into Formwerk, you must ensure that:
- you are permitted to collect and use that information;
- your use of the information complies with applicable privacy, confidentiality and marketing laws;
- the person has received any notice required by law; and
- the information is relevant and appropriate for the business purpose for which it is entered.
Formwerk is designed for ordinary business information. You must not use it to store highly sensitive information such as health records, government identification numbers, financial account credentials or payment card information unless Formwerk has expressly agreed in writing.
10. Children
Formwerk is a business service and is not directed to children. Users must be at least 18 years old or otherwise legally able and authorised to enter into an agreement to use the Service.
